Terms of Service (ToS)

If you submit a commission request, you agree that you’ve read and agree to these terms (I am not liable for clients lack to do so).

IF FOUND TO BE DOING SO, YOU WILL BE BLACKLISTED.

Client Responsibility:

• It's up to the Client to provide a recent/updated reference of the character(s), description and any other details for the Commission.

• The Artist is not responsible if the Client neglects to mention details the Client wants in their Commission, AFTER the sketch phase/WIP image, at that point it will be the Artist’s choice to apply changes at the Artist’s own discretion for a additional fee.

• If the Client’s wording is unclear and a mistake is made by the Artist based on unclear wording, it is not the Artist’s fault. It is the Client’s responsibility to be as clear as possible when describing what the Client would like in the Commission.

Editing Process and Policy:

• The WIP image is a sketch to primarily show the Client the character(s)/image’s poses, layout, look, and composition of the Commission.

• Once the initial (1st) WIP image is complete, the Artist will notify the Client with the image for approval.

• The Artist will send a notification once any minor edit(s) have been completed that will include the new (second) WIP image to be approved by the Client.

• Once the WIP image has been approved by the Client, the Artist will continue on to complete the Commission.

• If the Artist misread or drawn something completely wrong and it was clearly explained before hand, the Artist will make any edits to fix it, free of charge.

Client Use/Rights:

• The Artist has the right to refuse any request, even if the Client has submitted their commission request and has agreed to the ToS.

• The Client may re-upload as long as the Artist’s signature has not been removed. The art is of the clients character and they are free to use it however the client sees fit. you paid for it, it now belongs to you.

• The Commission may not be claimed as being created by the Client or other parties.

• All Commissions created by the Artist may not be used for commercial purposes or for profit of any sort by the Client (or other parties), unless the Artist was notified prior to starting the Commission, and terms were agreed upon by both the Client and the Artist.

• If the Client wishes to alter the Commission, in any way, permission is required by the Artist.

Payment Policy:

• Venmo is the current method of payment for commissions.

• Adult/mature content requests DO NOT have the same pricing as Regular requests, and are at the discretion of the Artist.

• Payment is due upfront, unless otherwise discussed.

• The Artist will not upload the picture until full payment has been received.

• The Client is welcome to provide tips, upon their own discretion. (Tips are greatly appreciated.)

• A payment plan can be provided upon Client’s request, for commission order(s) that are $100 USD or more.

•I no longer send invoices as the option is not available on Venmo.

•Price is subject to upcharge if down payment of at least 50% is not received as result of minimum 2 week invoice nonpayment without communication.

Cancellation and Refund Policy:

• The Artist reserves the right to cancel commissions at any time, for any reason. The Client will be notified and a partial refund of the remaining balance will be issued. This partial refund includes the cost of the work done prior to cancellation.

• If the customer has not responded to any messages (sketches sent for review, etc.) without any given reason, the commission will be canceled. A time limit of 1 month is given until a reminder message will be sent. Has the customer still not responded 7 days after the reminder has been sent, the commission will be canceled without further warning.

•The given money will then be treated as a donation/gift.

• If the Client cancels the commission request, prior to work starting, the Client is entitled to a full refund, minus transaction fees.

•If the Client's commission is on payment plan, refunds are not available.

• If the Client is being unruly, rude, unreasonable, or disrespectful to the Artist, for any reason, the Artist holds the right to cancel the Commission without a refund (or only issue a partial refund, based on the Artist’s discretion).

• If the Commission has been finished and the Client is unsatisfied in some way, the Client is not entitled to a refund. A discussion can be started between both parties to work out what made the Client unsatisfied, to which the Client can also request a rework of the Commission (with fees determined by the Artist).

Scheduling and Turn Around:

• All commissions are worked on by the Artist by the order of received payment. If the Commission must be completed by a deadline, the Client is responsible for stating so in the initial request or during the WIP phase. (An additional $30 USD to $50 USD fee will be incurred for rushed requests, and +$15 for every client ahead in queue.)

• Please allow plenty of time for the Commission to be finished.

• Turn around for a commission is NOT first come first served, I will be doing these at my leisure/ability depending on commission queue and the complexity of the commission (ie. detailed background, additional characters, etc). Queue is always open and clients are free to claim a spot at any time. commissions can stack and will require additional time to finish with this being the case.

Copyright Policy:

• A link back to the Artist is appreciated.

• The Client MAY repost to the Commission to their FA, use the image as an icon, wallpaper, etc., as long as it is for personal use ONLY. If the Client reposts to their FA, they must provide proper credit, as per the FA acceptable upload policy.

• The Artist is not required to keep any commissions in their gallery, scraps or possession.

• The Artist retains all artist copyright to the commission. The Client cannot state that they or any other parties drew the commission or attempt to sell the commission for the Client’s or other parties’ own profit.

Artist Use/Rights:

The Artist retains all rights to the commission artwork including, but not limited to:

• The right to refuse any commission at any time, for any reason.

• The right to post the Commission in the Artist’s galleries or any other art website/blog, for advertising or promotional purposes as well.)

• The Artist has full rights to any commissions and images that the Artist makes.

Other:

• There will be an additional fee, at the Artist’s discretion, for any character with a intricate design or extra body parts. LIMITS: 1 head, 6 limbs (-taurs), 2 wings, 2 tails

• There will be an additional fee, at the Artist’s discretion, for the following request(s) made by the Client. Once made, these request(s) cannot be refunded even if the Client changes their mind.

• The Artist has the right to change these terms and conditions without any notice, at any time.

•Please, Contact me if you- Change Usernames or Delete/Banned Social Media after commissioning me. I am not responsible for lack of communication or tracking you down when no info or contact is made/given.

If you are requesting a commission from me, you are saying that you have read and understood and accept these terms and conditions. Ignorance to these rules is not an excuse.

If Disabled/Neurodivergent and under 15 years old, the 25% discount is added to the total after the 50% discount if the commissioner qualifies.
